California Proposition 65 requires “clear and reasonable” warnings for products that contain chemicals on the state’s list of substances to cause cancer and / or reproductive toxicity. As of January 2021, THC has been a listed chemical that requires a warning, and the listing for marijuana smoke has changed. Manufacturers, distributors and retailers of cannabis and hemp products (including CBD) are responsible for evaluating their products and ensuring compliance with the updated requirements of Proposition 65.
